Jinhua Lucky Technology Co., Ltd. (hereinafter referred to as “Lucky”) would like to remind you that before using Lucky’s software “WiFi Fish Finder”, you must carefully read and thoroughly understand this Agreement, including the terms exempting Lucky from liability and the terms restricting your rights, and choose to accept or not to accept this Agreement.
By installing, copying, downloading, accessing or otherwise choosing to use WiFi Fish Finder, you acknowledge and accept this Agreement and agree to be bound by the terms of this Agreement.
This Agreement stipulates the rights and obligations between Lucky and you regarding the use of WiFi Fish Finder.
This Agreement may be updated by Lucky Online at any time. The updated terms and conditions of this Agreement will supersede the original terms and conditions of this Agreement upon publication without prior notice.
If you do not accept the modified terms, please stop using WiFi Fish Finder immediately. If you continue to use WiFi Fish Finder, you will be deemed to accept the modified agreement.
Lucky’s Terms of Service and later updates:
1.Software licenses
1) Subject to compliance with this Agreement, you are granted the limited, non-exclusive right to use Lucky on the mobile phone with WiFi Fish Finder installed.
2) You shall not modify, reverse engineer, decomcompile or disassemble, disassemble, sell, sublease or sublicensor the Products, or attempt to obtain access to the source code of the Products, or engage in any other attempt to obtain the source code of the Products.
No derivative work based on WiFi Fish Finder or any service provided by WiFi Fish Finder or any part thereof.
3) All rights not expressly granted by Lucky and WiFi Fish Finder shall be reserved by Lucky.
2.Use of software
1) In order to provide you with quality services more in line with your needs, Lucky WiFi Fish Finder will collect and use the following information about you and your use of Lucky WiFi Fish Finder (hereinafter referred to as Privacy Information) :
(1) Personal information: your ID card number, current residential address, telephone number, IMEI information, etc.;
(2) Location information: accurate information of mobile phone positioning;
(3) Other Information:
2) Lucky undertakes to collect your privacy information only for the purpose of providing services, and will not collect any operation information or file information unrelated to the functions of WiFi Fish Finder software.
Lucky will take various protective measures to ensure that the collection and use of your privacy information will not exceed the purpose and scope, and to ensure the security of your privacy information, so as to prevent your privacy information from being misappropriated, misused, and unauthorized access and disclosure.
3) Without your express consent, Lucky will not disclose, disclose or provide your privacy information to any third party.
However, Lucky shall not be liable for disclosure of your privacy information in any of the following circumstances:
(1) Lucky provides your privacy information in accordance with the provisions of laws and regulations or the instructions of competent authorities;
(2) Your privacy information collected by Lucky from legally publicly disclosed information;
(3) Disclosure of privacy information due to your own fault;
(4) You disclose privacy information to a third party;
(5) Any disclosure of your privacy information due to hacker attack, computer virus invasion or any other reason other than Lucky.
3.Statement of responsibility
1) Lucky shall not be liable for any claim based on or arising out of:
(1) Lucky shall not be liable for the intentional or negligent acts of users.
(2) Lucky is not responsible for problems caused by users’ linking and using the software with non-Lucky devices.
(3) The data and analysis results provided by Lucky have been professionally processed and are only provided for users’ reference without any responsibility for data or errors.
2) Lucky shall not be liable for the failure of WiFi Fish Finder due to the following circumstances:
(1) The network status of the communication operator, the communication line, or the service provider, etc. for any reason;
(2) Interference by hardware and software environment or human operation;
(3) Force caused by typhoon, earthquake, tsunami, flood, power failure, war, terrorist attack, etc.;
(4) hacker attack, technical adjustment or fault of telecommunication department;
(5) Software upgrade period;
3) If you meet riders or participate in related activities through WiFi Fish Finder, you should consider for yourself and at your own risk. Lucky does not assume any responsibility.
4.Termination of the Agreement and Liability for Breach
1) If you violate any clause of this Agreement, this Agreement will be automatically terminated and Lucky will hold you liable for breach of contract.
Upon termination of this Agreement, you should stop using WiFi Fish Finder.
2) If your breach of contract causes losses to Lucky or other users or third parties, you shall be liable for all damages. If Lucky assumes the aforementioned liabilities, you agree to compensate Lucky for related expenses and losses (including but not limited to compensation, legal costs, preservation fees, attorney’s fees, etc.).
5.Law Application and Jurisdiction
1) The validity, interpretation, modification, execution and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China.
2) Any dispute arising out of or in connection with this Agreement shall be settled by you and us through friendly negotiation or submitted to the people’s court where Lucky is located for adjudication.
6.Other
1) If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
2) The copyright of this Agreement is owned by Jinhua Lucky Technology Co., Ltd. Lucky reserves the right to interpret and modify it.
